Question you buy a digital product online, but to find out if it is suitable you have to use it, but if you use it, you cant get a refund.

Catch 22 ?

Legal under EU regulations?

Can't say why, no names to protect all parties, but would be interested to see if this gets closed and deleted?

14 day cooling off period

In the EU you have the right to return purchases made online or through other types of distance selling, such as by phone, mail order or from a door-to-door salesperson, within 14 days for a full refund. You can do so for any reason – even if you simply changed your mind.

The 14-day cooling off period does not apply to all purchases. Some of the exemptions are:

  • plane and train tickets, as well as concert tickets, hotel bookings, car rental reservations and catering services for specific dates
  • goods and drinks delivered to you by regular delivery – for example delivery by a milkman
  • goods made to order or clearly personalised – such as a tailor-made suit
  • sealed audio, video or computer software, such as DVDs, which you have unsealed upon receipt
  • online digital content, if you have already started downloading or streaming it and you agreed that you would lose your right of withdrawal by starting the performance
  • goods bought from a private individual rather than a company
  • urgent repairs and maintenance contracts – if you call a plumber to repair a leaking shower, you can't cancel the work once you have agreed on the price of the service

Not looking for advice just peoples opinions on the catch 22.

First you'd need to know if there actually is one. That's what the lawyer will be able to tell you.

They have confirmed, use it lose the right to refund even if not as described or unsuitable. So looks like my wallet will now stay firmly closed for the other party ;)

It's similar with many other products, if you make any changes to a product you'll have trouble getting your money back. For example you take a bite out of a bar of chocolate and decide you don't like it you'll not get your money back. And similarly things such as computer games, by playing it you make a change to the whole community. So if it was a game like WoWs how do you re-imburse players you shot, yes you may want your money back, but you've disadvantaged all those you've taken credits from while playing the game. You've altered battle stats, and there is no way you can recompense those players to give parity back so you could get your money back.
