Richelieu for me. I don't play the French BB's that much, TBH, but I'm surprised how effective they can actually be. Also, I'm surprised how good as some of the various mid tier cruisers can be. In the past, I played those ships more, though typically in scenario battles, when we still had a proper selection of them.... -

There's no question that video games are copyright protected, and there is some leeway how each company interprets that, Nintendo probably being the strictest out there. While 'Let's play' videos are allowed, those would usually have commentary/voice over meaning content contributed by the player, as with Flamu or Jingles, as you are saying. For that added content, you could assume the player/reviewer/commentator can claim copyright. However, if you only show recorded gameplay without anything added or contributed to it, I think it gets debatable if there is anything contributed. (Copyright is about intellectual property; compare recorded gameplay videos without added commentary to say, completed coloring books or filled in crossword puzzles.... how intellectual does that sound, and how copyrighteable would those in their turn be, because that's effectively the category those videos would fall under.) This type of videos may also fall foul of the game company's guidelines on licensing and/or Eula. That, however, as i see it varies between the companies. Few, in reality, I think would issue copyright strikes against even such videos, whereas most of the problems there are caused by unmuted in game music. What is or isn't copyright protected should be decided by law and the courts where needed. The problem is, this doesn't apply to YouTube as they have in place a 'copyright infringement system' which is open to abuse. There is no penalty (*for corporations or 'favored' megachannels that bring heaps of revenue for YouTube; NB) for invoking a false copyright claim for purposes of a video takedown and/or channel closure. Since this effectively means YouTube is exercising court authority without due process we go from the question of copyright infringement to infringement of judicial authority, again, without penalty. When a corporation is openly allowed to operate as a private court, I can only assume some really 'big money' is involved. What I'm effectively saying is, there are no real safeguards when it comes to YouTube. Most of the shenanigance there never reaches public conciousness, it's only in the rarest of cases when that happens and then you get those 'dumbster fires' happening. I think we can say there are ways for the video game companies as legal copyright holders to issue a copyright strike so that it remains 'technically legal', mostly by invoking something in the EULA, but at the price of some really bad press because it invariably raises questions as to what their actual motives are. As in this case. Again. Way to go WG(mz)... -

It's the derivative vs transformative, what we are talking about here I think. The way I see it, what you add to that performance is yours and can be copyright protected. It's just where you draw the line in all of that, and what is the relationship between the added content and the original content. It is critical what the game publisher has stated, via license or EULA regardless of that. -

Here is an interesting (long, detailed and technical) rundown of the problems. Interestingly, it also mentions the EULA which may be a relevant factor to consider. It actually isn't, at least not under the DMCA. There is no copyrighteable content in just plain playthroughs. However, as far as YouTube goes... the legal reality is suspended. To be clear, I mean if someone makes a gameplay video. The original game and related copyright is, of course, valid. -

'Each case is individual' ??? There's no way I find this acceptable, because it's anything but transparent. What does it mean? Individual how? Do they roll a dice to see if they will give a refund or not? IMO, if there is a refund policy in place, it should be 100% transparent. On the sellers side, there is legimite concern that the system is open for abuse, but in case there are limitations in place those should be clearly and openly announced so that the buyer is aware of the exact nature of the seller's refund policy prior to purchase.

They should be using content flagging instead, as those sort of things typically fall under ToS content restrictions. Copyright, theoretically... is an entirely separate issue. Since music is copyright protected it needs to be licensed. This is a clear cut issue, and this is why you have to mute in game music for game play videos, and also, in general, you have to mute any music in the background if you are publishing any live video footage where you might hear music in the background. " However, based on this letter, it appears here that Wargaming is admitting to attempting to use YouTube’s messy DMCA reporting system to censor the YouTuber not for his anti-Warships content but for his toxic content, which is still not the purpose of copyright interventions. " 'Messy' lol. This, of course, is strictly illegal in terms of the DMCA, but does it matter where YouTube is concerned.... huh? Yeah.. YouTube is the giant fly in the ointment here.... This seems a complex issue. Check YouTube ToS to see how they define jurisdiction, and as far as that goes it is clear. YouTube is supposedly complying with the DMCA, of course, as it is a US Corporation. There are some case you see on the Internet (as well as on YouTube) where a particular video is 'not available in your country due to copyright reasons', which is possibly where the kind of conflict you are describing is possible. How that is technically done, blocking videos in some countries and not in others, is done, that is to say, if it's done using YouTube's regular copyright claim if there is a different system in place. -

Generally speaking, the game companies allow the publishing of gameplay videos (which are not copyrighteable, incidently) and even monetization. What isn't allowed, is using third party copyright protected content, typically this means in game music unless it's licensed by the publisher. -

Well.. I could typically reach between 15 and 10. With luck, 10 was easy, with really good luck, even rank 8 was possible. That was my personal 'ceiling'. -

Well, in the old days, it gauged the players' skill level better through progression. Everyone managed to roughly to the level and rewards which matched their skill, and luck when it came to what sort of teams they were getting.
