The illegality was always concerning the Swastika iirc, not the Kaiserliche Kriegsflagge. As you can see most versions contain the Swastika, which might indeed cause legal issues in Germany, as you can only show it in educational historical contexts.

I'll try to find out, but my guess would be that it is simply not a high priority due to the low number of players running SLI systems.
